The possibility is always held out that you may become rich if not from your own efforts then from some unknown person ("the big fish") who might join your "downline. Short of termination, downlines can be taken away arbitrarily. It's a two tier residual affiliate program and it is obvious I want to build a downline and another income stream with it. Usually the program does not last, it gets shut down by the government really quick or the owners take all the money and go off shore and you never hear from them again. Either way it is over and done with shortly because it just does not last, that type of thing does get saturated.

But with a real program, with real products, and it has substance of value to it, there is no saturation, especially something that is really needed in the marketing place. For instance, in the program that I am in right now we have something that is really needed in the market place and that is marketing. Not only do we teach you about marketing but we also teach you about business savvy, things that will help your business. We also give you tools and things that not only will help you in this business but any business that you want to do in the future. If you are in college, if you want to be a doctor you have to go through some kind of schooling, usually eight years of schooling just to become a doctor, and during that time you usually do not get paid.

That is a sacrifice that they make. Any area in the medical field you probably can make pretty good money. I think doctors base salary is somewhere between a hundred and twenty to a hundred and fifty or a hundred and eighty thousand dollars a year, and it goes up from there. It depends on whether you are a surgeon or what type of specialty you go into. It can go up to three or four hundred thousand a year. That is the sacrifice that they make by learning their skill in order to make that type of money.

Also saturation cannot happen if you know what you are doing. When you know how to market, there is no such thing. As a marketer, if you are marketing and we are talking specifically about pay per click, this marketing method called pay per click, let us take an example like a newspaper. Let us say that you have a few local newspapers that you advertise in, even if there is only one in your area, let us say you advertise in this program, or some other product, you have your ad down, you ad is pulling, you have tested it and tweaked it over a few months, and you had a good ad in there and you were getting good quality conversions.

You have your landing page or your lead capture page set up to where you are converting subscribers and you are getting sales. Well, it is possible in that same newspaper that you have the same marketing ad week after week, people might become use to your ad, so they might just look over it, the target market that is reading the newspaper. So what do you do in that instance and how long does it take for this to happen. I have seen it from anywhere from sixty days to six months, maybe even eight months. Is there any specific time, no. It just depends on where you are advertising at and how the people respond.

But if you see your ad pulling and then all of a sudden it kind of starts slacking off, you need to change the ad as a marketer. Some people have run the same ad once they have tweaked it, or maybe they had a winning ad from the beginning without tweaking it, and all of a sudden for whatever product they are promoting on or off line, or whatever business opportunity, whatever they are promoting, they think it must be saturated or something is going on here, because I am not getting the response I use to get. No, that is not the problem, because you have to tweak your ads as you go along, that is marketing 101 since way back.

This will be the most important piece of information that you will ever read about weight training.

Repetitions… Your entire training career is composed of millions of them. You group them in sets and they are the basis of each workout. Performing them correctly is the difference between success and failure. A perfect repetition, seemingly simple, has many components and is powerfully effective. I am going to explain how to perform the perfect rep and why it is so important.

At the impressionable age of 14 I was lucky enough to be introduced to the world of weight training by a competitive bench presser and ex-Olympic wrestler. He was a cartoonish 5 foot 3, 65 kilo powerhouse with a barrel chest and black pony-tail mullet down to his arse. At his gym in Bellingen he would ensure that I learned and retained precise lifting technique during my first 12 months of training. Thank-you Kevin. Under his supervision I went on to become the Australian School-boys Bench Press Champion at the ripe old of age of 15 with a lift of 87.5 kilograms (192.5 pounds) at a HUGE (laughs) body-weight of 66 kgs (145 lbs). That was after only 6 months of training. Technique and intensity is EVERYTHING!

Kevin sold the gym to a great man called Scott who became a very close friend of mine, a fantastic training partner and the catalyst for my career in Personal Training. He looked somewhat normal in comparison to Kevin sporting a natural, balanced, muscular bodybuilder’s physique. His basic training philosophy was to hit each muscle group from every angle with perfect form designating set and exercise volume in proportion to the size of the muscle group, i.e. back being the most complex and largest received the most exercises while biceps being one of the smallest received the least. I learned a lot from him. Exercise form was always at the fore-front of his teachings.

>From Kevin I discovered that each exercise has an optimum movement path to generate maximum power safely. Scott showed me a broad range of exercises and how to apply good technique to each of them for consistent effectiveness and efficiency. I have taken these lessons with me throughout my career and applied them to my training and the hundreds of exercises that I have created myself.

Anyone who knows me will find that I am extremely particular about good exercise technique. I pay very close attention to the body position and movement pattern adjusting fine components so that the exercise is totally optimised. I must annoy the hell out of my clients sometimes. It works though.

WHY IS PERFECT EXERCISE TECHNIQUE SO IMPORTANT?

Reduced Risk Of Injury…

If you are to remain injury-free throughout your training career you must practise safe, tight, controlled lifting technique for every single repetition. If the movement is as close to biomechanical perfection as possible you will receive maximum stimulation with minimum risk. Injuries will halt your progress every time and can be very serious. Any chance to avoid them should be harnessed, implemented and retained.

Decreased ‘Cheating’ And Involvement Of Unrelated Muscle Groups…

If your form is sloppy there is a good chance that you are not hitting the target muscle as completely as you could be. As soon as your technique declines other muscle groups come into play assisting during the lift, often in an unsafe manner. A classic one is allowing your torso to swing during a bicep curl using your lower back, glutes and hamstrings to get the weight up. There is not only the danger of hurting yourself there is also the probability that you are not taking the target muscles to failure. Keep the form tight and you will stimulate the muscle safely and entirely.

Decreased Involvement And Fatigue From Ancillary Muscle Groups…

Related to the last point the execution of a perfect repetition every time will ensure the target muscle is isolated and fully fatigued before the ancillary muscles (assisting muscles) give out. To make this more clear I will describe two examples where this is a common occurrence. Example 1: when you perform a back exercise if you do not focus on engaging and isolating the targeted muscles of the back then the forearms and biceps will crash and burn before the back is fully worked. Example 2: when you perform a chest exercise if you do not focus on isolating the pectorals during the movement then the triceps and anterior deltoids will give out first impeding the progress of the chest. It is easy for ancillary muscles to come into play during an exercise if your form is sloppy because they are there to assist the movement. But because they are smaller and weaker if you do not make sure that the target muscle is completely fatigued first they will always give out holding backyour progress.

Increased Motor Neuron Innervation And Muscle Fiber Activation…

If you isolate the target muscle group and contract it slowly and intensely through the entire movement you will activate the greatest amount of muscle fibers. A safe and full range of motion (ROM) will involve muscle fibers from the origin (initial attachment) right across to the insertion (final attachment) of the muscle. A slow, intense, precise movement during the entire concentric contraction (muscle shortening) and eccentric contraction (muscle lengthening) will innervate more motor neurons ‘firing’ more muscle fibers. This will facilitate a maximum activation of the muscle fibers and total muscle contraction maximizing strength and muscle gain.

Improved Mind-Muscle Connection…

The mind-muscle connection is your ability to feel the target muscle contract completely and under total control during the execution of an exercise. Usually a muscle group that you find difficult to feel and to develop is one that you have a poor mind-muscle connection with. Consistent, strict form on all of your repetitions will help you gain control of these stubborn body-parts. The mind-muscle connection improves when the path from your motor cortex (the control centre of your brain for movement) to the working muscle becomes more efficient.

Improved Focus, Discipline, Intensity And Quality Of Training…

This level of precision for every single repetition that you perform during your workout demands a massive amount discipline, will-power and intensity. You control the movement of every exercise and apparatus as though it were part of your body. Be patient and apply it to all exercises performed until it becomes second nature. By this stage it will feel awkward to train with sloppy technique and you won’t miss it because you will become stronger and more muscular and injury-free.

COMPONENTS OF A REPETITION

1. Starting Point – where the body is in the appropriate position to begin the Repetition.

2. Concentric Contraction – where the muscle shortens as the weight is lifted through the predetermined Range of Motion (ROM). Also called ‘The Positive Phase’.

3. Mid Point – the point of greatest contraction at the top of the Repetition where you pause briefly before releasing the weight.

4. Eccentric Contraction – where the muscle lengthens as the weight is released to the Finishing Point. Also called ‘The Negative Phase’.

5. Finishing Point – same as the Starting Point.

GUIDELINES TO PERFORMING THE PERFECT REP

Learn And Practice Proper Technique…

There are over 300 hundred exercises; learn them before you perform them.

Apply And Maintain Proper Technique…

Once you have learnt the exercise guidelines make sure you apply them to your training in the gym precisely and consistently. If you forget how to do something go back to the site and look it up.

Repetition Speed…

The repetition speed should for muscle growth and strength in bodybuilding, shaping and toning and for general health should be medium (1-2 seconds) during the Concentric Contraction (where the weight is lifted) and slow (2-5 seconds) during the Eccentric Contraction (where the weight is released). The exact seconds required for each phase of the repetition depends on the size of the range of motion (ROM) of each individual exercise. Example; Calf exercises have a smaller ROM so the time required to perform the repetitions slowly would be reduced. Squats, on the other hand, have a large ROM so the time required to perform the repetitions slowly would be increased. Performing exercise with speed is not without merit and it is prevalent in functional training, power-training, and sport-specific training but there is an increased risk of tissue injury with the sudden force exerted when lifting. There is also greater focus on the tendons, ligaments, bones and joints rather than the muscles.

Ancillary Muscles And Stabilizers…

You cannot perform an exercise safely or effectively unless your body is positioned in accordance with the guidelines for that exercise. This means that once you are set your ancillary muscles (the direct assisting muscles for the movement) and the stabilizers (the muscles that hold the rest of the body in the correct place) must be engaged so that a perfect repetition is performed every time. This will make your body safe, strong and functional.

Abdominals And Core Muscles…

It doesn’t matter which exercise you are performing your mid-section must be switched on for total maximum gains. The abdominals and the core inner muscles of the spine are the superstructure of the body which holds everything together under the stresses of exercise. They lock you safely into the correct position and maintain it during the set. Engaging them properly will stabilise the body, increase your total strength, increase the strength of the abdominals and core muscles themselves, protect the spine and facilitate the implementation of perfect repetitions for all exercises. * To use your mid-section properly during exercise pull your lower abs in towards the spine, pull in the obliques, contract the entire abdominal complex and lift the chest *

Symmetry And Precision Of Movement…

To be certain that both sides of your body develop evenly you must ensure that each exercise is executed symmetrically. Human bodies are never built with faultless balance and the rigours of life make that deviation from perfect symmetry even more profound. To diminish the impact of this continuing you need to train in front of a mirror as much as possible or utilise the constant critical eye of a training partner. This will allow you to supervise and fine-tune your exercise technique at all times reducing imbalances of strength, muscularity and functionality.

Range Of Motion…

Most of the time you need to use a full range of motion (ROM) to stimulate the all of the muscle fibers from the origin, across the belly (the middle bulk), to the insertion of the muscle. If you cheat and continuously use partial repetitions you will lose flexibility and miss out on muscle and strength gains from the outer angles. There is a limit, however, to how large the ROM should be. It is individual to each exercise and should be large enough for maximum muscle fiber stimulation without causing any joint or tissue injury from over-extension. There are techniques and set sequences that are based on partial repetitions but they have their own strict technique and should be used sparingly for shock tactics and variety.

Breathing…

You need to breathe properly during each repetition to maintain a continuous delivery of oxygen around the body to the working muscles. It will also reduce the build-up of carbon-dioxide. This will give you the energy to power through the set and decrease the onset of blood lactate accumulation (OBLA – that awful burn from lactic acid which is caused from glycogen being burnt for energy without the presence of oxygen). Breathing properly also takes the pressure off your cardio-vascular system facilitating normal function under conditions of high stress from intense exercise. It is important to keep the blood pressure down and unnecessary strain off the body as no-one is unbreakable. Another advantage of full, rhythmic breathing is that it will pace the tempo of your repetitions. You can’t take slow, full breaths if your reps are fast and messy.

BASIC BREATHING TECHNIQUE DURING A REPETITION

1. Take a slow, deep intake of breath as the weight is released (when the target muscle stretches and lengthens during the eccentric contraction).

2. Breath out more forcefully as the weight is lifted (when the target muscle engages and shortens during the concentric contraction)

3. There are alternate breathing techniques but this one is simple and safe so remember: breathe in when the weight is released and breathe out when the weight is lifted.

INTENSITY

Finally we come to my favourite word; Intensity. To cause the greatest amount of muscle fiber damage and to induce growth producing chemistry within the body you need to push each set to absolute failure or beyond. By that I mean that you make sure you grind out each repetition with perfect technique until it is not possible to perform another without losing your form. Everything You've Always Wanted To Know About HIPAA And FERPA


Consider this question. Say the mother of a 22-year old student that you have treated requests to see her daughter’s medical records. The Bursar’s office confirms that the student is listed as a dependent for tax purposes. There seems to be no urgent reason for such a release and the student does not wish to give her mother access. How would you protect the privacy of her information?

Situations such as this one that require knowledge of privacy laws to resolve successfully are all too common in the average student health center, yet the acronyms HIPAA and FERPA tend to strike fear into the hearts of the staunchest of college health professionals. So much has been written anecdotally on the subject of how complicated and unspecific these laws are that some may be surprised to find that according to legal professionals, the intersections between the laws are generally clear-cut. This article aims to explain which laws apply to you and what you can do to avoid the headaches that ensue from a conflict between your principles as a care provider and the law.

This is how these rules break down.

RULE 1: FERPA never applies to non-students

RULE 2: FERPA only applies when the student’s medical records are released

The Family Educational Rights and Privacy Act (FERPA) is the older of the two federal privacy laws. Enacted in 1974, one aspect of its governance is the privacy of educational records. There is a popular myth circulating that student medical records fall under the FERPA’s umbrella term “educational records”. In fact, FERPA specifically excludes the treatment records of students in higher education from its definition of educational records (see USC 20, 1232g for a complete definition). It also excludes employees of an educational institution if they are not students. FERPA does come into play, but only if the records are released to someone outside the health center, whether that is the student, their parents, their professors, or another health provider outside the university, at which point they become “educational records” rather than treatment records.

It is important to note that it is not the request for the release that brings FERPA into effect. Many student health professionals believe that if a request to see the records is made that is in accordance with FERPA guidelines, they have to release them or be in violation of FERPA. Not so, says Kristine Dunne, BA, EdM, JD, an associate at the Washington, D.C. office of law firm Arent Fox, LLC.

“It's the release of the records that triggers FERPA,” she explains. “There are no rights extended under FERPA to those medical records until such time as they have been made available to someone other than the treating health professionals, at which point the FERPA protections of student records kick in.”

Applying this to the example at the beginning of the article, if state law doesn’t require you to release the student’s unreleased medical records to her mother, you are under no legal obligation to do so without a court order. Similarly, even if you think a professor may have a “legitimate educational interest” in requesting a student’s unreleased medical records, you still don’t have to release them.

FERPA is just one part of the puzzle, however. The Health Insurance Portability and Accountability Act (HIPAA) of 1996 is another relevant law that seeks to be the national privacy standard in health care. It was updated in 2003 to take into account the trend toward automation and electronic record-keeping. These privacy guidelines have been well publicized and generally uphold the kind of patient confidentiality that most health care providers are comfortable with and there has therefore been a widespread trend in health centers to apply these standards to student medical records, even if they are not legally required. It is important to realize, however, that while its principles of privacy and confidentiality are excellent, in most cases, compliance is not required by law.

RULE 3: HIPAA doesn’t apply to records covered by FERPA or to student medical records which are made, maintained, or used only in connection with the provision of treatment to the student, and are not available to anyone other than persons providing such treatment.

RULE 4: Even if you treat non-students, you’re not bound by HIPAA unless you transmit health care information in electronic form in connection with the submission of claims for payment.

HIPAA’s definition of protected health information (PHI) specifically excludes education records covered by FERPA and the treatment records of students in higher education as defined above. Dunne explains that the goal of this exclusion is simplification.

“If student medical records were subject to HIPAA, there would be two completely different schemes – up until the health center released the record, it would be governed by HIPAA, and when it had been released it would be governed by FERPA,” she says.

This was apparently considered unworkable by Congress, hence the blanket exception that HIPAA makes for any kind of student medical records. However, many student health and counseling centers also treat non-students, and this is where it starts to get a little bit trickier. To be considered a “covered entity” (i.e., bound by HIPAA), your health center must electronically transmit health information in connection with a “HIPAA transaction”. More detailed information on what constitutes a HIPAA transaction can be found in this primer released by The American Council on Education, but essentially it is any administrative or financial task carried out in the course of health care that transmits PHI. If you don’t perform electronic transactions, you don’t have to comply with HIPAA.

RULE 5: Student health and counseling centers that do perform electronic transactions for non-students only have to abide by HIPAA for those transactions.

Usually, every transaction of “covered entities” has to be bound by HIPAA standards, even if they are not all electronic transactions. However, because of the intersection with FERPA, these health centers are able to be bound by HIPAA just for the non-student transactions.

RULE 6: State laws are applicable whether or not other federal laws apply

With all the fuss about HIPAA and FERPA, don’t forget about your state’s laws concerning privacy. In some cases, state laws are the only ones that will apply to student medical records, but even where HIPAA or FERPA apply, state law is still relevant. Despite the fact that HIPAA is a federal law, it bows to state law in those cases where state law is more stringent. Arent Fox Associate Richard Liner, BA, JD, MPH, elaborates:

“HIPAA has an enormous pre-emption problem because it sets a floor and not a ceiling for health care privacy. Congress only established a minimum for protecting patient information. If a state’s laws or regulations are more stringent than HIPAA in their protection of patient health information, then covered entities must follow state requirements.”

This may conjure up ideas of conflicting laws, but Arent Fox counsels that generally, state laws are more specific and will very rarely conflict directly with HIPAA or FERPA. If more than one law is applicable, generally the more stringent requirements will apply. When in doubt, consult counsel before taking action.

Knowing the theory is one thing, but applying it can be a lot more complicated. FERPA requires the student to give written, dated permission before his or her student records information is released – even to other health care providers outside the university, which is a source of frustration for many. But the same information can be released, unauthorized, to school officials who have a “legitimate educational interest”. Similarly, FERPA allows unauthorized disclosure in an emergency, if it is “necessary to protect the health or safety of the student or other persons”. Dunne counsels to rely on common sense to interpret these terms, and to consult counsel early in the process. No law can specifically cover every eventuality; the burden of responsibility and interpretation must, through necessity, rest on the care provider.

This responsibility weighs all the more heavy because schools are concerned about penalties for breaching FERPA. If the Family Policy Compliance Office (FPCO) found a pattern of violations of FERPA with no obvious attempts to follow the guidelines, it could result in a removal of federal funding. However, it is important to know that individuals cannot be prosecuted for a FERPA breach and individual students cannot sue for damages for such a breach. Schools should carefully develop, implement and maintain compliance oversight with regard to these important privacy laws in order to prevent unlawful release of student records. Likewise, if your school treats non-students, files electronic claims and is bound by HIPAA for those transactions, you should make sure that HIPAA protections are implemented, even though a HIPAA violation may not – for now – result in a fine being imposed. Liner explains:

“In the vast majority of cases where there’s found to be a violation of HIPAA, there is what’s called an ‘administrative resolution’, which generally means the mistake wasn’t intentional and the organization voluntarily agrees to take appropriate remedial action.”

No civil fines for violations of HIPAA have been imposed so far, although Liner warns that is likely to soon change.

Although information on the triumvirate of privacy laws has always been available to those who know where to look for it, there is also a wealth of partial and incorrect information available on the Internet that has muddied the waters for those health professionals attempting to do a little research on the laws that apply to them. Dunne and Liner counsel that you should speak to a professional who knows the law in your state and the ins and outs of FERPA and HIPAA if you are worried about misinterpretation of the law. Even if you know the basics, state laws vary greatly and knowing the details of how the three laws intersect will allow you the greatest leeway to interpret them in a way that is consistent with your ethics.

“It is complicated,” sympathizes Liner. “Talk to the privacy officer within the university, if there is one. There are also a few government Web sites that are really good in terms of user-friendly guidance to help people navigate through the more basic pitfalls.” For instance, the Office of Civil Rights, the enforcement agency for the HIPAA privacy standards, offers tremendously helpful information and FAQs on its Web site.

“Consult with your legal counsel to ensure you’re interpreting and applying the law correctly,” adds Dunne. “And be clear to those who use student health center services, especially students, about the laws that apply.”

Is homework wreaking havoc in your home? If the answer is YES, then finding the real causes behind the homework problems, and taking steps to resolve them, will improve both school success and family harmony.

How do we know? Homework is the single biggest issue affecting home life, according to many of the parents who bring their children to us at STRONG Learning Centers®.

Here are the ten most common causes of homework problems, along with suggestions to help you resolve them.

1. THE HOMEWORK IS TOO DIFFICULT.

If the homework is continuously too difficult, with everything that entails, then a child will try to avoid it. Look into the cause. Begin by having a conversation with the teacher. If the problem is class-wide, hopefully the teacher will evaluate and adjust the nature of his or her homework assignments. If the problem is limited to your child, she may require additional help from the teacher after school, from you, from a sibling, from a teenager you hire, or from a tutor. If this fails to resolve the issue, then a reevaluation of the type of class, or course level, or teaching vs. learning style, or school may be in order.

On the other hand, the cause of the problem may be a disability: physical, learning and/or attentional. Your child may have difficulty in such areas as: hearing, seeing, reading, processing language, or writing, or she may have ADD or ADHD. If the problem is one of these, sometimes it is easy to resolve. For example, corrective glasses can easily resolve some seeing issues and behavioral therapy and/or possibly medication might help AD/HD, the newer term for the disorder. In many cases, consulting teachers, counselors, or specialists in the appropriate field, might be in order.

Note: If you suspect AD/HD, a valuable resource is CHADD (Children and Adults with Attention-Deficit/Hyperactivity Disorder organization). For information on the learning disability (LD) issue in general, contact the Learning Disabilities Association of America (LDA).

2. THE HOMEWORK IS TOO CONFUSING.

When children chronically complain that assignments or directions are confusing, they are likely to become frustrated and/or anxious, eventually avoiding such assignments. Parents usually respond to these children by asking, "Weren't you listening?" Or "Just read the directions!" The children were listening or reading, but they may not have been able to process the information.

In this case, the cause may be reading comprehension and/or language processing problems. You may need to seek the help of teachers or a learning specialist to help your child learn strategies she can use to overcome or compensate for her disability. For example, she may need to put the words into pictures or graphic organizers. Children who become confused due to problems with language processing, do better when they can see things visually.

And, regardless of who is working with them, be sure they remain actively involved. Children (and adults too) are notorious for shaking their heads "yes" when asked "Do you understand?" even when they don't understand. Sometimes they are just yessing you and sometimes they think they understand. However, when you ask them to explain or discuss what you were just talking about, they realize that they really don’t understand.

If neither of these areas are the cause of the problem, then you may need to investigate why your child continues to complain. If it turns out it is simply a ploy to get you to do the work with him, then you need to address the reason for that behavior. But wait – before you get annoyed, remember what it was like for you when you were a child. Homework isn't always fun, and sometimes it's nice to have a little company. Your child may simply want your company during homework time. Wow! How's that for the ultimate compliment?

3. THE HOMEWORK IS TOO LOW-QUALITY OR TOO BORING.

Sometimes homework assignments are low-quality boring busywork and children will avoid them simply because they don't want to do them. Unfortunately, one of life's little lessons that children need to learn is that sometimes we simply have to do boring things. If, however, every assignment appears to be dull, too easy, or too low-quality, you may need to talk to your child's teacher to determine the purpose of the assignments. Many teachers do not realize how some of the assignments are coming across to the children; chances are they will appreciate the feedback and adjust the work as appropriate.

4. THE CHILD IS DISORGANIZED.

He brings home the book and forgets the assignment. He brings home the assignment and forgets the book. Or he forgets the assignment and the book. Does this sound familiar? If so, it sounds like you've got yourself a disorganized child. The same is true for children who can’t judge time or can't manage their time. They may have the best intentions to get the homework done, but somehow it gets lost in their time-maze.

It is so difficult for disorganized children to get their homework done that some of them would rather lie, insisting that there is no homework, than be criticized and punished. If poor organizational skills seems to be the issue, there are many books and articles that offer great strategies to help the disorganized child. 5. THE HOMEWORK IS TOO INTRUSIVE.

It's a fact; homework cuts into playtime. So what's the problem? The problem is that in some cases homework time creeps up to the point of consuming the home lives of the children and sometimes that of the family as well. Besides the obvious down side, this may be harmful to children's intellectual development. Their brains are developing and they need to use all parts, and good quality play provides opportunities to use the "far corners" of the brain that might otherwise remain fallow. So, it turns out that children need to play. Surprisingly, brain research indicates that occasional boredom is good, too, as it forces children to think of things to do — that is, to use their brains to create.

So if homework time seems to have taken over your home, work out a schedule with your child so that he doesn't have to lie in order to play.

6. TOO MUCH PARENT INVOLVEMENT.

Some parents are overly involved in their child's homework. Here are the three most common types, all of whom tend to drive their children toward lying and deception. If any of these describe you, then work to change your behavior.

A. The "perfectionist parents." Perfectionists demand picture-perfect-homework. Their children hate to let them see their homework papers out of fear that they will judge the work unworthy, tear it up, and make them do it again. Besides being tedious and time demanding, in these extreme cases it is downright disrespectful of the child.

B. The "helicopter parents." These parents hover over their children, making sure that every "t" is crossed and every "i" is dotted. They think they're being helpful, but here's the problem: By not giving their children any breathing room, they are delivering the tacit message that their children are not capable of doing the work themselves. Not only does this harm their self-esteem, but it also denies them the opportunity of taking responsibility for their own work.

C. The "Pandora parents." The children of Pandora parents tend to deny the existence of any homework they don't understand because asking Mom or Dad even the simplest question is tantamount to opening Pandora's box. Their well-meaning parents can't contain their enthusiasm and turn what would ordinary require a short answer into a long-winded treatise on some esoteric detail.

7. THE CHILD IS UNMOTIVATED.

Most children don't want to do homework. But while they may put up quite a fuss, somehow they manage to get the work done. If they don't, motivation may not be the problem; they may appear unmotivated, but this may be a convincing protective screen they've set up to mask a larger issue.

For example, many children appear unmotivated when in fact they avoid homework to protect their egos. How's that? Because these children erroneously equate failure with stupidity. Their logic is as follows: If they try and fail, it is a reflection of their intelligence. If they don't try and fail, it is not a reflection of their intelligence; it is due to lack of motivation or irresponsibility. These labels they can live with; the label "stupid," they can't!

8. TOO MUCH HOMEWORK.

Many kids simply cannot keep up with the projects, tests, quizzes, reading and other assignments they are given.

Here is a general guide for the typical amount of time children should be expected to spend on homework each school day. Grades K-2, about 10-20 minutes. Grades 3-6, about 30-60 minutes. Grades 7-12 will vary considerably, depending on subjects, projects due, tests, etc., but a reasonable average is about two hours, with more on weekends, as needed, for major projects and exams.

If your child spends considerably more than this on homework, look into the cause. Begin by having a conversation with the teacher. If the problem is class-wide, hopefully the teacher will make adjustments. If the problem is limited to your child because your child works slowly, or has other issues discussed in this section, talk to his teacher and see what can be done to modify his assignments.

9. IT'S TOO NOISY.

Many kids complain that they can't concentrate at home. Their siblings are running around, TVs and music systems are blaring, someone's on the phone, people are fighting, the dog is barking, the baby is crying. I don't know about you, but I need quiet to do work that requires thinking. Closed bedroom doors don't help much, as the muffled sounds of chaos always manage to get through.

Here is an idealistic solution. Even if it can't be carried out fully, at least it is something to aim for. As a family, consider designating a block of time as quiet time. Normal living continues, but more quietly than usual. Kids can use the time to do homework; parents can read, balance the checkbook, and write e-mails; those who have time to watch television can do so with headphones or the sound turned low. Sometimes quiet sounds pretty good, doesn't it?

10. THE CHILD IS TOO ALONE.

Some children are lonely when required to do homework in their rooms, and don't work efficiently in that setting. Some need continuous support and direction. That is, they need someone to help them stay on task or to provide a little assistance when they get stuck. If required to work alone in their rooms, these are the kids who emerge three hours later with little or nothing accomplished. Both groups of children tend to prefer doing homework on the kitchen table. This way they have people around them, either for support or company.

So, if homework causes chaos in your home, look into the reasons. Once you find them, and do what you need to resolve the problems, you'll be back on the road to school success and family harmony.

Is it worth the extra money to purchase an elecgtronic dictionary with sound?

The following comments have specific reference to learning Spanish but I believe they are relevant to the learning of other languages as well.

Some people (curiously and unfortunately, not all) who learn a new language are interested in achieving a good accent in their new language. Nevertheless, it is not well known that there are three components of the accent of a given language: the rhythm or intonation (the music) of the language, the links between the sounds, syllables, and words in an utterance, and lastly, the proper pronunciation of the sounds of the language. The lesson here is that the formation of the vowels and consonants of a language is only part of the task of learning that language. However, it is where most learners begin. Let’s look at the place of the pronunciation of the vowels and consonants of Spanish.

Many language experts believe that the intonation and linkage contribute more to speaking like a native than does the proper pronunciation of all the sounds. This can be seen in the manner in which the people of San José, Cost Rica pronounce the Spanish letter “ere”. For some strange reason, which I have not been able, to track down historically or linguistically, they pronounce the word “arroz” just like a Gringo would. Their double “r” is not trilled as in most Spanish speaking countries; it is not velar as it is in much of Puerto Rico. It is pronounced just as an untrained American would pronounce it. Yet, the person hearing this “error” has no doubt that the persons speaking are native speakers of Spanish. The flow of their speech is perfect and the listener just thinks, “I wonder why they pronounce that word that way…” In other words, often the pronunciation of the sounds is the least important element of speaking well.

Yet pronunciation is the place where the learner should begin. Habits of bad pronunciation once ingrained become automatic and are hard to eliminate, while errors of intonation and linkage can more easily be consciously detected and corrected in later stages of the learning process.

The person learning Spanish has one advantage over the person learning another language. The advantage is that most the vowels and consonants of Spanish are close to those of English, and their pronunciation is perfectly regular.

First of all, the vowels sounds represented by the 5 letters, a, e, i, and u, have five sounds. That’s right, five! It is not like the case of the many English vowel sounds represented by the same letters, such as rough, cough, though, and through, or the case of the same sound represented by different letters in the words, ache, weigh, pay, hey, jail, and tape.

The major difference is that the vowel sounds in Spanish are pure; they do not have the little “tail’ that English vowels have.

The consonant sounds in Spanish are largely similar to those of English. This does not mean that they are all the same! There are differences with the “l”, “b” and “d” sounds. The main difference with some consonants in Spanish is that they are not “aspirated”, that is they are not made with a puff of air, as are those of English. If you put the back of your hand in front of your mouth when you say “Papa” or “tonto” in Spanish you should not feel the same movement of air that you feel when you say “Pope” or “tent” in English.

These differences are real but fairly manageable by the learner who wants to start off right in Spanish. Once the differences are known they can be worked on. For example, it is relatively easy to leave off the English glide at the end of the Spanish vowels.

Progress can be made with written descriptions of the Spanish sounds. The sounds can be described by comparing them with close English words. And the ear can be trained by listening to native speakers. There are many speech samples on the Internet and most large cities in the United States have at least one Television channel transmitting in Spanish.

All of the above has the purpose of leading into the issue of the value of a “talking” dictionary. Many people who want to learn Spanish think that they need a talking dictionary. Often the learner thinks that this will provide an advantage in learning the language. However, it is a mistake to invest in a talking dictionary. The very best are very expensive and most of them, even the most expensive, have such small speakers that it is impossible to hear the fine points of the pronunciation of Spanish.

The learner very soon knows how to pronounce Spanish since the rules are 100% regular. What is need is the effort to actually pronounce the sounds. Many learners are ashamed of imitating the sounds of the language they are learning and they speak the new language with the same intonation, linkage, and pronunciation of their own native language.

The end result of the learner’s pronunciation (as of his or her overall accent) will be the result of his or her own ability and of the effort expended. The talking dictionary does not contribute anything to the equation. So What? Who cares? What is Customer Service? What are the repercussions? What does it represent? Who are the culprits? What can be done about it?

Dear Reader,

I've had enough. After being brought to the point of anger where profanity would've been my next utterance, I've decided to 'vent my spleen' in this article, highlighting the cause & effect the breakdown of quality customer service is having on our society.

I'm sure if you've ever had a bad experience with customer service, you will appreciate some of the points and suggestions I make in this article. Before I begin, let us first establish what is 'good' & 'bad' customer service.

WHAT IS GOOD CUSTOMER SERVICE?

To be greeted politely with eye contact & a pleasant countenance;

To be spoken to with a clear, even, tone.

Always ready to listen than assume;

Always prepared to provide assistance.

Ensuring the customer is never kept waiting unnecessarily.

Ensuring your attitude is geared to assistance & understanding;

Providing unknown but helpful advice to the customer;

Delivering/responding on time.

WHAT IS BAD CUSTOMER SERVICE?

Intolerably long queues/idle staff;

Calls not answered within 2 minutes.

To be put on hold for more than 3-5 minutes;

Following call-scripts instead of listening to the customer's problem;

Late or no arrival of delivery with no explanation;

Unexplained & unwarranted blocks on credit/debit cards;

Unjustified high service charges or penalties by financial institutions;

Misinformation causing expense to customer;

Poor workmanship;

Sour, cynical, unhelpful attitudes;

Overcharging/hidden charges;

Withholding useful/valuable information;

Inadequately trained staff.

WHO ARE THE MAIN CULPRITS?

Mainly Banks, Supermarkets, Home Shopping Centres, Mobile Phone Companies, Mechanics, Fast Food outlets, Service engineers - plumbers, gas fitters etc.

Virtually any large institution is, but not exclusively, a culprit of bad service.

WHO CARES?

We are in a time where a majority of people are in debt and we are in debt to the very major institutions that provide poor service.

If I'm going to spend my hard earned money with you and possibly add to my debt, the very least I can expect is to get what I pay for without fuss, rudeness and with value for money. It's as if these institutions think "you or someone else is going to spend your money with us anyway, so why should we bother about customer service? - You'll be back!"

Banks, Home Shopping Centres et al

We all lead busy lives where time is of the essence, yet the queues in Banks etc. get longer & longer. It is not unusual now for someone to spend 45 minutes of their lunch hour waiting to be served in a bank.

There have been numerous times when I've had to ask a member of staff to open another till to alleviate the queuing - why couldn't they do this of their own accord? Why did it need me to point out the obvious? This is indicative of the attitude business has towards their customers.

By the way, you are legitimately allowed to ask a member of staff or management at any venue or outlet to open another till & start serving customers if it's obvious the queues are too much for the member/members of staff currently serving.

WHY ARE THEY GETTING AWAY WITH THIS?

We are in a time where government is increasingly forcing us to 'accept our lot' in life; 'SHUT UP, BE HAPPY'!

(To prove my point I could expand here into 'Game Theory', 'Negative Freedom' and our budding totalitarian state, but I'll leave that for a future article!).

Add to this the 'sheep' & 'don't make waves' mentality of the British and you have a nation that is ripe for arrogant, sloppy business practices. >If we can't be bothered to take action, they don't need to respond.

The irony is that under the present political climate it is assumed by government and the captains of industry that what we buy is a true representation of our wants & needs and therefore a true representation of democracy.

Yet we fail to see the power that belief gives us, the consumer. No matter how much small print and word trickery is invested into an organisation's Terms & Conditions, we are still protected under Consumer Law which has been strengthened considerably over the past decade.

HOW DID THESE PRACTICES SEEP INTO OUR NATION?

I would like to suggest a number of possible factors:

One factor is the Americanisation of Britain - our government taking existing American policies and tailoring them to suit the British economy - that was started under the Thatcher era, and continued with fervour under the Blair government.

Anyone who's visited the West Coast of America frequently like I have will know that 'service with a smile' is not a standard approach, be it from a public servant or an average serving citizen. The "Time Is Money" principle is applied with fervour.

A second factor is the practice of globalisation. We are in a world where foreign companies can own any company in any country, even if it's considered to be a major culturally important institution of that country.

Successive British governments from the Thatcher era onwards have made it clear that anyone willing to invest is welcome & ensure our virtually non-existent union laws make this country a viable prospect.

Add to this the fact that a company residing in Britain may have a telephony service in India and a production factory in South-East Asia, and you can see how loyalty to an ideal can be become a passing thought.

A third factor is technology. The advent of automated lines, email & text communications, in addition to internet shopping, is creating a nation where person-to-person communication is rarely practised, therefore there is less patience when performing the art of speech. Pitch, Inflection, Courtesy, Tone, Understanding, Rate & Enunciability are fast becoming a quaint approach to communicating.

A fourth factor is immigration. With a large influx of people from all over the globe, the importance of good customer service in this nation needs to be highlighted when you have people from Australia to Zaire whom haven't been raised with the British shopkeeper mentality & may have been brought up to believe that getting the job done is good enough. It isn't.

A fifth factor is staff consideration - which may range from poor pay to poor working practices to poor working environment. Good pay is not enough to motivate staff; almost every employee survey carried out on job satisfaction puts pay 3rd as the most important requirement for an employee.

Giving an employee a sense of worth goes a long way to a happy workforce - although this needs to come from the employee as well; if money is the only motivation to work and nothing else, make sure you never deal with customers. Go and work on a production line somewhere - we don't have to deal with your lack of ambition or self-worth.

Taking pride in whatever you do goes a long way to affecting your approach to a task.

HOW WOULD THIS AFFECT CUSTOMER SERVICE IN BRITAIN?

Policies can direct and shape a culture.

Policies shape the decisions of what products will or will not be available; how they will be available; how much they cost. These in turn will shape our buying and shopping habits.

This in turn will help to shape attitudes and practices throughout society.

Modern day communications have made vast savings for big business; the trade off of unhappy customers as a result seems to be worthwhile in their eyes.

Britains reputation and culture was built on its customer service. The nation continues to trade on that reputation from being the first called to provide UN relief to being the first contacted to train police forces of the developing nations. The British workforce used to think it a grave slight on their character if they were accused of bad service. Now, in the event of a complaint, the manager pretends indignation in front of the customer and ridicules their 'pettiness' behind their back. "The Customer Is Always Right" is from a bygone age.

WHAT ARE THE REPERCUSSIONS?

The repercussions are already being felt.

The increase in these no-win, no-fee companies is a testament to that.

The second stage is the unpleasant aspect of public servants being attacked, verbally or otherwise. Indeed, were the figures for physical assault on public servants and shop assistants to be measured over the past 20 years, I'm guessing they would show a sharp increase.

The third stage - which has already begun - is when customers start taking individual action in small claims courts when they are not happy with the conclusion of a complaint to a Customer Services Dept. Increased, continuous litigation on big business cannot be a good thing for a company in terms of cost and man hours.

WHAT CAN BUSINESSES DO?

Branch Services

-Any organisation that makes sure customers are not queuing for more than 5 minutes per customer will see their volume of visits triple.

-Make sure there are never more than 5 customers per till person.

-Make sure that whatever your staffs is doing - no matter how important & time sensitive they think it is - as soon as a long queue has developed, get them on the tills or assisting to clear the queue.

-Even if customers are still queuing for some time, they will appreciate the attempt and the importance you place on their custom.

-If there are processes & procedures that have to be performed throughout a business day, there should be a flexible contingency method that enables the staff member to help clear long queues then get back to their procedural matters or conclude them in a quiet period.

-Any branch of any business that takes the above stance will see their volume of customers increase.

Telephony Services

-Ensure the option to talk to an actual person is on the 1st list of menu options offered.

-Teach your staff to actually listen to the problem.

-Teach your staff not to be menu-driven when giving support.

-Ensure the Reduction of waiting times is a constant priority.

-Design the menu options you offer from the customer's point of view.

WHAT CAN CUSTOMERS DO?

When making a telephone call, have a piece of paper and pen ready.

Always seek the name & job title of the person you're speaking to and write it down.

Ask to speak to/see the manager or senior member to make a verbal complaint.

If that fails, seek the name of their customer services manager - they have to give to you.

Seek the address of the customer services department for complaints - it may be different than their standard customer service dept.

Find out the email address of the person or department you need to speak to.

Write to the relevant person. In these instances the pen is truly mightier than the sword.

Send letters recorded delivery. Someone has to sign for it.

Organisations still have to reply to a written letter by law.

-A list of the good and bad accessible to all.

-Management of respective business presented with a daily/weekly/monthly list of complaints to resolve. Their response monitored.

-Highlight bad/good Company of the week/month.

-Arrange boycott of bad company/branch through their respective local press. Promote good company/branch.

The following advice is written for women who haven’t yet made a commitment or a baby with a “bad boy.” She may be struggling with whether she is ready to settle down with him, distance herself from him or keep him as a friend. Although the best advice is not to offer to carry him or his burdens and just leave him alone, there will be those women who will still stay. If those women choose to stay, they have committed themselves to a hard life of many restless nights, aches and pains at times mentally and/or physically and they most likely will past negative behaviors to their future children and their children.

The Liar – In the beginning of the relationship, you caught him in a few white lies. He had what seemed like convincing excuses; therefore you let him get away with them. Now the lying has increased and the excuses have become minimal if not at all. Actions you may want to consider are the following: Approach him not only with what you think, but what you know; in other words have proof. Stop taking his lying lightly. Let him know that this behavior you will not accept any longer. If he chooses to continue lying, then tell him you will have to end the relationship for good. Once you have made a decision that you are leaving, begin to make efforts to not be contacted by him (change your cell phone number, block his email address, put places you hang out frequently on hold, and avoid telling mutual friends about your personal whereabouts, thoughts and feelings. You must not leave and then go back to him, he will only get better about lying to you over time.

The Player also known as The Pimp – This man is obsessed with being contacted or making contact with the opposite sex. He will use cell phone, email, your house phone or friends to make contact with whomever he meets. He will leave a trail of evidence whether it is the popular piece of paper that slips out of his pocket with a phone number without a name, restaurant receipts, hotel charges, cologne or jewelry gifts, read and sent email that sits in his account that he forgot to delete. He begins to create a pattern in his actions when you have become old and someone else becomes new. Look out for this repetitious pattern. He may develop his pattern after work on a daily basis working later and later nights at the office then when he comes home he is providing almost too much detail about what happened at work or not at all. Another pattern he may create may be choosing a hobby or interest that is very unusual to his personality and attending this faithfully, what you can do to find out if he is sincere is offer to pick him up from the pottery class on some nights. Watch his reaction. There may also be the weekend pattern of always “needing to get away, have some time to myself, or I’m so busy with errands.” All the while making little or no time for the two of you to go out and be seen together. When you suggest new places to visit, he finds an excuse to take you to the same area you both are familiar to keep from running into the other woman or women. He finds a way, anyway, to travel to places without you regularly using an excuse such as “I’m going to my mother’s house or hanging out with Rick, Joe or someone you never heard of Frank.” Be careful family and friends will cover for him. He will call you, at times when he knows you are out and about to see if you will be in the proximity where he will be entertaining the other woman or women. He is protective of his cell phone and his computer; if you tried to check either it maybe password protected. You may want to consider whether having to worry over your man’s whereabouts is worth all of this aggravation. In time, you will become insecure, angry for no apparent reason, and develop a since of distrust toward everyone you meet. This is baggage you don’t need.

The Thief – He has been around when things go missing. At first you didn’t suspect him and thought items had just been misplaced or he blamed someone else for taking them. Yet, you have always had a funny feeling in your gut that he was the one who made off with your dad’s tools, took your favorite CD, helped himself to some cash sitting around, and other important items. It is time to come up with a plan, set him up. The kind of plan you come up with can’t be easily figured out by him and if you sincerely want your restless conscience to be at peace, then go to great lengths to figure out whether he is trustworthy. Time is money and the longer you stay with him, the more items will go missing.

The Hustler – He is always thinking of a way to separate people from their money illegally. From identity theft to standing on the street corner selling drugs, he always has a knot of money and doesn’t mind living lavishly. Now you may think that what he has told you about his daytime job is paying the bills, but the truth of the matter that job didn’t pay for the designer clothing and expensive jewelry you wear; instead it was the second one you may or may not know about. This man is dangerous. He has enemies and one day some one will catch up with him, you or anyone who associates with either of you, and the sight won’t be pretty. You must ask yourself this question, is he worth putting your life and everyone else’s lives around you in danger?

The Abuser/Controller – You can never do anything right. He is often critical, walks around with an attitude and every opportunity he has alone he wants you to stop living your world to be with him. In the beginning of the relationship, you justified his negative personality with excuse after excuse. Whether he is physically ill, illiterate, disabled or mentally disturbed and on medication, you have a right to explain how you feel about him to him. You may have done this already and got knocked to the ground whether verbally or physically. You may have told yourself that things will get better and he is making an effort to change. Well that is good if he is sincere about becoming a better man; however, he can make those strides without you living with him and subjecting yourself to his name calling, mood swings, choking, punching, and grabbing. There are no rewards in heaven given to women who allow themselves to be abused by men. There was only one Christ in the Holy Bible and you are not He. The Mooch – You have invited him once again on an outing and he never has any money in his wallet. During inopportune times, he says he needs to stop at the ATM and you know there is none even close to where the two of you are located. When he offers to take you out, he usually picks a place that he doesn’t have to pay much (despite the fact that when it was on your tab he ordered steak and another time lobster!) He drives your car and doesn’t fill it up, when you mention it; he finally puts some gas in the tank -- a measly $5 or $10. Holidays come and go with very little if any acknowledgement from him. Yet, you bought him (and possibly his relatives) really nice gifts whether it was a holiday or not. He displays affection, says all the right things, and listens to your concerns only when he knows he needs something from you. If you choose to continue a relationship with this man you have options and they are as follows. You could stop being so generous and treat him how he treats you. For example, when you invite him out, treat him to the kind of places he takes you. Put a limit on how often he drives your car. Avoid helping him when he is in a bind since you know he won’t help you. Make yourself unavailable to run errands for him and anyone associated with him (that includes his children by a previous relationship, his mother, sister or brother.) If he begins to see you are no fool, he won’t continue to run over you and will grow to appreciate you. However, if he doesn’t you will be making it easy for him to walk away from you without you having to break up with him.

The Drunk/ Drug Abuser – How many times have you seen him intoxicated or using drugs? Is he fun, angry, disgusting or depressed afterward? Are most of the relationship problems you have been facing associated with this type of behavior? If so, then you will have to consider whether or not you will help him get counseling from a distance, continue to live with him and endure the abuse, leave him alone altogether or create an intervention for him that includes a professional counselor, family and friends who have all been affected by his negative ways. If he consistently refuses help, then for your own sanity and safety, leave him alone.
